He served on the Board of Directors of My Sisters&#8217; Place, one of the leading domestic violence agencies in the country for 14 years, including four years as Chairperson. As a result, many domestic violence agencies have referred clients to Mr. Goldstein because he is one of the few lawyers with expertise in domestic violence and because of his willingness to take cases on a pro bono or reduced fee basis. Mr. Goldstein has also worked with the Community Change Project of the Volunteer Counseling Service in Rockland County, New York since January of 1999 teaching domestic violence classes for men who have been convicted of domestic violence crimes.<\/p>\n\t<h2><a href=\"https:\/\/casetext.com\/analysis\/why-i-wrote-this-book-barry-goldstein-the-quincy-solution-1?fbclid=IwAR3TQD2iux4ycmrQ-xhJ1s9bCJh4irXDmxILYmVZKgaVELC2TDCuxbjEskE\">Why I Wrote This Book: Barry Goldstein, The Quincy Solution<\/a><\/h2>\n\n<p>Oct 22, 2014<\/p>\n<p>I have seen too many tragic stories where abusers kill women, children and sometimes police officers out of their sense of entitlement to control their partners. In custody courts children are routinely taken from safe protective mothers who are the primary attachment\u00a0figures and forced to live with dangerous abusers. These stories are far more painful because most domestic violence crimes can be prevented.<\/p>\n\n<p>From the late-1970s until the mid-1990s, leaders in Quincy, Massachusetts developed a group of best practices that dramatically reduced domestic violence crime. District Attorney Bill Delahunt noticed that virtually every inmate at a nearby high security prison had a childhood history that included domestic violence and often sexual abuse. He believed that by preventing domestic violence he could reduce all crimes and this is exactly what he accomplished. A county that averaged 5 to 6 domestic violence homicides annually enjoyed several years with no murders. Communities like Nashville and San Diego enjoyed similar results from these best practices.<\/p>\n<p>In the course of interviewing leaders from Quincy, someone gave me a link to medical research based on the ACE (Adverse Childhood Experiences) Studies. ACE demonstrates that children exposed to domestic violence, child abuse and other traumas will suffer more illnesses and injuries and their life expectancy is reduced. The essence of domestic violence is that the abusers seek to coerce and scare their partners to do what he wants. Living with the fear creates enormous stress in abused women and children and this leads to many health and societal problems including cancer, heart disease, stroke, diabetes, AIDS, auto-immune diseases, depression, PTSD, suicide, substance abuse, auto accidents and crime.<\/p>\n<p>Our society has always tolerated what we now call domestic violence and child abuse. The present level of disease and social problems is based on this tolerance so that when we take effective actions to prevent domestic violence public health will improve and costs will be reduced. The United States spends $750 billion annually on health costs related to domestic violence. The additional costs of crime and the failure of victims, children and abusers to reach their economic potential means that this unintended abuser subsidy costs over one trillion dollars annually. I believe the best practices in the Quincy Solution will quickly save $500 billion. These savings will provide a huge incentive for public officials to implement the Quincy Solution and make women and children safe in their homes.<\/p>\n<p>The effective practices in Quincy included strict enforcement of criminal laws, orders of protection, probation rules, practices that make it easier for victims to leave their abuser and a coordinated community response. I have updated this work to include new research, technology like GPS and the custody courts. Bill Delahunt noticed that victims stopped cooperating when their abusers sought custody. This did not derail the success in Quincy because at the time it was a rare tactic. Today it is a standard tactic for the most dangerous abusers to seek custody as a strategy to regain control over their victims, but the custody courts are so anxious to keep even dangerous fathers in children&#8217;s lives that they fail to recognize or respond effectively to abuse reports.<\/p>\n<p>The custody courts must be part of the Quincy Solution because the ability of abusers to manipulate the court to regain control over their victims undermines the work to prevent domestic violence. We seek to accomplish this with the Safe Child Act which says that the health and safety of children must be the first priority in all custody and visitation decisions. Many people are surprised this is not already the law and we have received a good response from legislators because the remedy seems so obvious.<\/p>\n<p>The custody courts are particularly bad in responding to reports made by mothers about possible child sexual abuse. Although deliberate false allegations occur less than 2% of the time, the custody courts give custody to alleged sexual abusers in 85% of the cases. This means many children are sentenced to live with their rapists. The courts routinely use flawed practices and have trouble believing that a father who is successful in other parts of his life could commit such a heinous act.<\/p>\n<p>This routine failed response led to a horrific miscarriage of justice in the Elsa Newman case. In the midst of a disputed custody case in which there was strong evidence the father was sexually abusing the children, the boys&#8217; godmother went to the father&#8217;s home, found him in bed with one of the boys and naked from the waist down. In the struggle for her gun a shot went off and hit him in the leg. The father immediately decided to use this crime to try to silence and discredit the mother, Elsa Newman.<\/p>\n<p>Dr. Eli Newberger was a professor of pediatrics at Harvard and one of the leading experts in child sexual abuse. He found that the investigation of sexual abuse allegations in the Newman case was particularly flawed and these mistakes led to the report being disbelieved. The prosecutors had no evidence linking Elsa to the crime. They attempted to convince Margery Landry who committed the crime to testify that Elsa was involved. She refused to do so because Elsa had no involvement but the jury was not told this. The prosecutor was allowed to suggest that Elsa had deliberately made false sexual abuse allegations based on the failure of the custody court to use proper practices. This and prejudicial publicity led to the conviction of an innocent woman. She has been jailed for over a decade. Subsequent research including from the US Justice Department supports her innocence but thus far Maryland has been unwilling to correct this injustice.<\/p>\n<p>I had to write this book because we have the ability to dramatically reduce domestic violence crime. This will improve the lives of battered women and their children.
